The “Disinterested Witness” Requirement
In Colorado, a Living Will is only valid if signed by two disinterested witnesses. To ensure your document isn’t rejected by a hospital’s legal department, witnesses must meet strict criteria:
- Cannot be a blood relative or related by marriage.
- Cannot be an heir or beneficiary of your estate.
- Cannot be your attending physician or their employee.
- Cannot be a creditor or have a claim against your estate.

What if the signer is on medication?
A medical living will notary must ensure the signer has “capacity.” If the signer is heavily sedated or unable to understand the document, we cannot legally proceed. We recommend scheduling during “peak alertness” hours.
What ID is required in a hospital?
The signer needs a valid government-issued photo ID. If an ID was lost during an emergency admission, Colorado law allows for notarization via “Credible Witnesses” who can swear to the signer’s identity.
